The Thing convened according to traditional schedule—annually at minimum, sometimes seasonally, occasionally in emergency session when urgent matters required immediate resolution. A designated official opened the assembly, speaking formulas that had been passed down through generations, words that transformed the gathering from collection of individuals into legal body with authority to make binding decisions. The exact words varied by tribe, but the essence remained constant: the Thing was declared open, participants were reminded of their obligations to speak truth and accept community judgment, and the boundaries of permissible discussion were established.
Cases were presented in order of severity—capital crimes first, then major disputes over property or status, finally minor grievances and administrative matters. The accuser spoke, presenting his case according to traditional formulas, any deviation from proper wording potentially invalidating the accusation. The accused responded, also following prescribed formulas, offering defense or acknowledging fault. Witnesses were called, their testimony weighed according to their status and reputation, free men’s words carrying more weight than freedmen’s, established community members believed more readily than strangers.
The assembly deliberated publicly. Any free man could speak, offering interpretation of law, citing precedents from previous Things, arguing for particular judgment. This was not chaos but structured discussion, participants understanding that their words would be remembered, that arguing for unjust outcome damaged their own reputations, that the community judged not only the accused but also those who judged him. The process could take hours or days for complex cases, the assembly refusing to rush to judgment when careful consideration was required.
Judgment emerged through consensus rather than voting. The assembly discussed until broad agreement formed, the majority position becoming obvious through accumulation of speakers supporting it, dissenting voices gradually silencing themselves when they recognized their isolation. Formal vote was rare, consensus interpretation being sufficient in most cases. When genuine division persisted, the assembly might postpone judgment, allowing time for further deliberation, or might split the difference, finding compromise position that satisfied neither side completely but prevented open conflict.
